A trademark can manifest itself in many different forms. Trademark registration can be based on a name, a combination of words, images, symbols, or any other characteristic element of the brand. This can include three-dimensional figures such as containers or packaging.
There are several types of trademarks that can be registered and depending on their characteristics they can be classified as:
- Word mark: when the trademark registration is for a name without a logo.
- Graphic mark: when a drawing is registered, not including text or letters.
- Mixed mark: when the trademark consists of words and graphics (logos).
- Three-dimensional mark: packaging, wrapping, etc.
Atypical marks: colors and sounds.
Trademark registration according to geographical area
There are different types of trademark registrations depending on the state in which you want to use your trademark.
- National trademark registration: offers protection in the country where it is protected.
- EU trademark registration: offers protection in all 27 member states of the European Union. The United Kingdom is not included due to Brexit.
- International trademark registration: offers protection in the selected countries where you want to register your trademark, provided they are members of the international trademark treaty. Otherwise, the trademark must be protected nationally in the selected country.
National trademark registration will grant your trademark protection in the domestic market. Registering your trademark in the European Union will grant you uniform rights in all EU member states. EU trademark registration is done through the European Union Intellectual Property Office (EUIPO).
International trademark registration allows you to register your trademark in several countries around the world. The difference with registration in the European Union is that international registration is not unitary, and therefore, at the time of application, you must select and pay the corresponding fees for each country where you wish to register your trademark.
International trademark registration is carried out through the Office of the World Intellectual Property Organization (OMPI). Once granted, each trademark application will be processed as if it were a national trademark application.
