Industrial design registration will give you exclusive rights to your design, regardless of the dimensions. Registration will offer you 25 years of protection from the date of application.

What is an industrial design?

A registered industrial design will allow the holder to have the exclusive right to the appearance of all or part of the product derived from the characteristics of the lines, contours, colors, shape, texture, or materials of the product itself or its ornamentation. The design can be either two- or three-dimensional. The exclusive right to the design will entitle the holder to use it or to prohibit third parties from using it without consent.

What can I register as an industrial design?

Design registration provides protection for the aesthetic appearance of a product as long as:

  • Be innovative
  • Have an individual character

It is important to note that an industrial design application may include variants of the same product. It is important to emphasize that a maximum of seven different views may be submitted for each design (main elevation, rear elevation, top plan, bottom plan, right side view, and left side view).

Registered designs must comply with the Locarno Classification, which defines 32 different product classes. Each design may only be registered in a single class that corresponds to the designed product.

Designs that serve only a technical function, official symbols or emblems, or those contrary to public order may not be registered.

Areas of protection of patent registration

National Design Registry

The Spanish design registration is limited to the national territory of the country where it is registered. However, during the six months following the filing of the application, it may be extended through the Community design registration and the international design registration. This may be done within the so-called 6-month period and/or priority rights. This way, the design would maintain the same application date as the first filing in the country of origin. After this 6-month period, the design would be protected only in the country where it was initially filed and cannot be extended to other countries due to lack of novelty.

Community design registration

The Community design registration offers protection in the Member States of the European Union. The application process is carried out through the European Union Intellectual Property Office (EUIPO).

Registration of international designs

International design registration is carried out through the International Design Registration system. This registration will offer protection for your design in all countries participating in the Hague Agreement.

The international design registration system offers certain advantages, such as simplifying and unifying certain procedures, such as formal examination and publication in each of the countries where you wish to formalize the process.

This process offers several advantages, such as reduced costs, since a single international application will provide coverage in all countries where you have filed for patent registration.

It should be noted that the PTC application is not, in itself, a patent. After the international application, you will need to comply with all the requirements of the country where you wish to formalize the patent.

For countries that are not part of the PTC, the patent must be registered nationally.
