A utility model is a title that grants the exclusive right to exploit an invention, preventing others from manufacturing, selling, or using it without the owner’s consent. The invention protectable by a utility model is unique due to its “utility” rather than its “aesthetics and/or technical complexity.” Inventions involving processes, biological matter, and pharmaceutical substances and compositions cannot be protected as utility models; these should be protected as patents.

It is important to note that once applied for, an industrial design (MU) has a priority period of only 12 months. During this period, protection for the same industrial design (MU) can be extended to any other country and would be granted the same application date as the first registration in Spain. Regarding industrial designs, the priority period is reduced to 6 months. After these periods of 12 and 6 months, respectively, protection will remain only in the country where the invention was registered.
