The invention to be protected with a utility model, as with a patent, must be novel, possess inventive step, and have industrial application. Unlike a patent, which takes into account novelty on a global scale, a utility model only considers the state of the art in its national territory.

Registering a utility model will provide protection for ten years from the date of application.
Scope of protection
The utility model is a specifically Spanish title and is not a unified registration in Europe. Depending on the geographical area, you can apply for, for example, the equivalent of the “certificat d’utilité” in France, the short-term patent in the Benelux area, and others. Each country where registration is desired must apply independently.
The countries that do accept utility model registration are: Argentina, Armenia, Australia, Austria, ARIPO, Belarus, Belgium, Brazil, Bulgaria, China, Chile, Colombia, Costa Rica, Czech Republic, Denmark, Estonia, Ethiopia, Finland, France, Georgia, Germany, Greece, Guatemala, Hungary, Ireland, Italy, Japan, Kazakhstan, Kenya, Kyrgyzstan, Malaysia, Mexico, Netherlands, Peru, Philippines, Poland, Portugal, Republic of Korea, Republic of Moldova, Russian Federation, Slovakia, Spain, Tajikistan, Trinidad and Tobago, Turkey, Ukraine, Uruguay, and Uzbekistan.
It is important to note that once applied for, an industrial design (MU) has a priority period of only 12 months. During this period, protection for the same industrial design (MU) can be extended to any other country and would be granted the same application date as the first registration in Spain. Regarding industrial designs, the priority period is reduced to 6 months. After these periods of 12 and 6 months, respectively, protection will remain only in the country where the invention was registered.
